1. Acceptance of Terms

By accessing or using the QIQ website (qiqtest.com) and the Quantum Intelligence Quotient assessment services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services. The Services are provided by the Advanced Learning Academy ("ALA," "we," "us," or "our").

2. Eligibility

The QIQ assessment is intended for individuals aged 14 and older. If you are between 14 and 18 years of age, you must have the consent of a parent or legal guardian to use the Services. By using the Services, you represent that you meet these eligibility requirements.

3. Account Registration

To access the QIQ assessment, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Assessment Services

4.1 Description. The QIQ assessment is a cognitive evaluation that measures performance across six brain regions using a proprietary 60-220 scoring scale. Each score is verified through quantum computation across seven demographic dimensions. Upon completion, you receive a comprehensive cognitive assessment report.

4.2 Assessment Conditions. The assessment should be completed in a single sitting, in a quiet environment, without external assistance. Using reference materials, receiving assistance from another person, or using automated tools during the assessment constitutes a violation of these Terms and may result in score invalidation.

4.3 Score Delivery. Your QIQ report will be available within 24 hours of assessment completion. Most reports are delivered within 2 hours. Quantum verification processing times may vary based on system demand.

5. Assessment Limitations and Disclaimers

5.1 Not a Clinical Diagnosis. The QIQ assessment is an educational and informational tool. It is not a clinical diagnostic instrument. QIQ results do not constitute a psychological or neuropsychological evaluation, a diagnosis of any cognitive condition or disability, a medical opinion, or a substitute for professional clinical assessment. If you have concerns about cognitive function, learning disabilities, or neurological conditions, consult a qualified healthcare professional.

5.2 Limitations of Measurement. While QIQ employs rigorous methodology including quantum verification, all cognitive assessments have inherent limitations. Factors including fatigue, illness, test anxiety, environmental distractions, and temporary emotional states can affect performance. A single assessment score is a snapshot, not a comprehensive evaluation of cognitive capacity over time.

5.3 Equivalency Estimates. Equivalency mappings to other intelligence scales (WAIS-IV, Stanford-Binet 5, Cattell, Raven's APM, Woodcock-Johnson IV) provided in your report are statistical estimates derived from concurrent validity studies. They are approximate and should not be treated as official scores on those assessments.

5.4 No Employment or Academic Guarantees. A QIQ score, regardless of level, does not guarantee any particular outcome in employment, academic admissions, or other competitive contexts. QIQ reports are provided for personal informational purposes.

6. Pricing and Payment

The current price for the QIQ assessment is listed on the assessment purchase page. All prices are in United States dollars unless otherwise specified. Payment is required before assessment access is granted. We accept major credit and debit cards. Prices are subject to change; however, any price change will not affect assessments already purchased.

7. Refund Policy

7.1 Seven-Day Refund Window. If you are dissatisfied with the QIQ assessment for any reason, you may request a full refund within 7 days of your assessment purchase date by contacting us at assessments@advancedlearning.academy.

7.2 Conditions. Refund requests must be submitted within the 7-day window. Refunds will be processed to the original payment method within 10 business days. After 7 days, refunds are granted only at our discretion for documented technical issues that prevented assessment completion.

7.3 Report Access. If a refund is issued, access to your assessment report will be revoked. Your anonymized assessment data will remain in the norming database as described in our Privacy Policy.

8. Intellectual Property

All content, materials, and technology comprising the QIQ assessment — including assessment items, scoring algorithms, the quantum verification methodology, report templates, website design, and textual content — are the intellectual property of the Advanced Learning Academy and are protected by copyright, trademark, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any QIQ materials without our prior written consent. You may share your personal QIQ report for personal, non-commercial purposes (such as sharing your results with family, educators, or employers with your consent).

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE ASSESSMENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ALA and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your violation of these Terms, your use of the Services, or your violation of any rights of a third party.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Changes will be effective immediately upon posting. Your continued use of the Services after the posting of modified Terms constitutes acceptance of those changes.

13. Termination

We may suspend or terminate your account and access to the Services at any time, with or without cause and with or without notice, if we believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately. Sections 5, 8, 10, 11, 14, and 15 shall survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

15. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be submitted to good-faith negotiation between the parties for a period of 30 days. If the dispute cannot be resolved through negotiation, it shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Delaware. The decision of the arbitrator shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ALA regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether oral or written.
